Privacy Policy

All scans at First Glance Ultrasound will be performed by a qualified enhanced practitioner sonographer or midwife sonographer all with previous NHS experience. Ensuring your consent, the main purpose of the scan is to check the fetal wellbeing of you baby by determining viability, size (gestation), detecting any anomalies and position. If your sonographer identifies any possible anomalies, these findings will be openly discussed with you and documented into your scan report. In these circumstances a referral will be made to the Fetal Medicine Department at the Norfolk and Norwich University Hospital. With your permission, a copy of the report findings will also be sent. Following this, it is your responsibility to ensure that you then consult with your NHS care provider.

  1. All scans performed at First Glance Ultrasound are not intended to replace primary healthcare providers service and should not be used as the only diagnostic services used throughout pregnancy. It is vital that you attend for all NHS antenatal services  as the main aim of the screening services is t identify any abnormalities. The report provided after each scan at First Glance Ultrasound Ltd will document a brief diagnostic overview of your pregnancy and is often completed at a gestation different to your NHS scan. Therefore, the detection rate of abnormalities may be reduced. However, as a registered healthcare provider we have a ‘Duty of Care’ as a registered professional to refer onto the appropriate healthcare provider should any anomalies be suspected. At First Glance Ultrasound we have a relationship with the Norfolk and Norwich University Hospital Fetal Medicine Unit and Antenatal clinic. If any anomalies are detected during your scan a referral will be made to the Norfolk and Norwich Hospital and a report of the findings will be provided.

  2. There may be occasions when a transvaginal ultrasound scan is required, this is often the case during the early stages of pregnancy between 6 – 15 weeks. If a transvaginal scan is required, the examination will be explained in detail and a consent form will need to signed. Please be aware that if a transvaginal scan is declined, we may not be able to provide conclusive information.

  3. First Glance Ultrasound accepts no liability for incorrect identification of gender. Please be aware that fetal sexing is not a guarantee and is only 95% accurate. Accuracy of fetal sexing increases after 16 weeks gestation. 

  4. Obtaining images- There is no guarantee of image quality, in all circumstances the best possible images will be required, however, there are limiting factors that may make it difficult to obtain images required, these can include but are not limited to 

    — Fetal Position

    — Body Habitus

    — Late gestation

    Undertaking scans at a different gestation to the optimal screening time may result in reduced image detail and information.

  5. Rescan Policy – If we are unable to provide fetal sexing of the day of your scan, one further appointment of 15 minutes will be offered free of charge. Following this, if we are still unable to identify gender, any further scans will be charged but at a discounted rate. If we are unable to provide a clear image of your babies face during a 3D/4D appointment, we will offer a complimentary 15 minute scan in attempt to try again. However, if this is still not obtainable, any further scans will be charged for at a discounted rate. 

  6. All clients will understand and accept that at First Glance Ultrasound does not have access to medical history and cannot provide medical advice.

  7. Age Restrictions - Please be aware that any patients under the age of 18 years of age  (16-17 years of age) will need to attend with a Parent, Legal Guardian or responsible adult. We cannot scan anyone under the age of 16.

  8. All scans require a 50% deposit upon booking with the remainder payable on the day. We accept cash, debit or credit cards. 

  9. Cancellation Policy – We require 48 hours notice of cancellation, any appoimtments cancelled within this time frame will result in the retention of the deposit. Late attendance - 

  10. Please be aware that we do not allow photography or recording in our clinic. 

  11. Liability – First Glance Ultrasound Ltd is not responsible for any injury, loss or damage to personal belongings whilst on the premises.

  15. Delays outside our control. If we have to delay or amend the date or time of your appointment due to an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. This may be as a result of any technical issues, changes in law or regulatory requirements. Provided we do this we will not be liable for delays caused by the event. If there is a risk of substantial delay you may contact us to end the

Interpretation

‍ ‍

·         First Glance Ultrasound Limited whose registered office is at Bradford House Yarmouth Road, Stalham, Norwich, Norfolk, England, NR12 9PD (Company No: 16709967) (the Company/ First Glance Ultrasound/ we/ us) agrees to provide Services to you (the Client) subject to the following terms and conditions (the Conditions).

·         The Company is regulated by the CQC [details of registration[CT1] ].

‍ ‍

·         These Conditions constitute the entire agreement between the parties and shall prevail any other terms or conditions contained within the Order and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between the Company and the Client relating to its subject matter.

‍ ‍

 

‍ ‍

·         These Conditions apply to the exclusion of any other terms that the Client seeks to impose or incorporate, or which are implied by trade, custom, practice or course of dealing. Any variation, including the introduction of any additional terms and conditions, to these Conditions, shall only be binding when agreed in writing.

1.             The Contract

‍ ‍

1.1.      The Company provides the following services:

‍ ‍

(a)        Ultrasound fetal wellbeing scans (Scans) including the following:

‍ ‍

                            i.        Early Pregnancy viability and reassurance scans (from 6 weeks gestation – 14 weeks) (Early Viability and Reassurance Scans)

‍ ‍

                           ii.        Gender reveal and fetal wellbeing scans (from 16-32 weeks)

‍ ‍

 

‍ ‍

                          iii.        Growth and presentation scans (not required if you are having growth scans within the NHS fetal growth pathway) (from 24- 40 weeks)

‍ ‍

 

‍ ‍

                          iv.        Baby bonding scans (from 24-32 weeks)

‍ ‍

 

‍ ‍

                           v.        3D/4D ultrasound scans (From 26 – 32 weeks)

‍ ‍

(Services).

‍ ‍

1.2.      Booking an appointment with us for any of the Services is deemed to be an offer by you to purchase the Services.

‍ ‍

1.3.      The offer as described in clause 1.2 above shall only be deemed accepted when we send confirmation to you that your appointment has been booked.

‍ ‍

2.         The Services

‍ ‍

2.1.      All Scans will be performed by a qualified practitioner sonographer or midwife sonographer employed or engaged by the Company (Qualified Sonographer) and the Company confirms that Qualified Sonographers will have previous or current experience working within the National Health Service (NHS).

‍ ‍

2.2.      You understand and accept that the Company will not have access to your medical history and cannot provide medical advice to you. 

‍ ‍

2.3.      The Company cannot provide Scans for any person under the age of 16. Any Client’s aged between 16-17 may only attend a Scan with a parent, legal guardian or responsible adult.

‍ ‍

2.4.      Following completion of the Scan, the Company will provide a scan report to you providing a brief diagnostic overview of your pregnancy and will include information on fetal position, viability, size (gestation) and any anomalies that may be apparent from the Scan (Scan Report).

‍ ‍

2.5.      Trans Vaginal Scans

‍ ‍

(a)          In addition to a Scan, there may be occasions when a Transvaginal Ultrasound Scan (TVS) is required, and this is typically the case during the early stages of pregnancy (6 – 15 weeks).

‍ ‍

(b)          If a TVS is required, we will hold a consultation with you to discuss what to expect during the examination, and prior to conducting any TVS, we must obtain a signed consent form from you.

‍ ‍

(c)          Should the Client decline a TVS, you acknowledge that we may not be able to provide conclusive information in the Scan Report.

‍ ‍

2.6.      Any performance dates specified by the Company shall be estimates only and time shall not be of the essence for the performance of services.

‍ ‍

2.7.      The Company reserves the right to amend the Services if necessary to comply with any applicable law or regulation, or if the amendment will not materially affect the nature or quality of the Services, and the Company shall notify you in any such event.

‍ ‍

2.8.      The Company warrants to you that the Services will be provided using reasonable care and skill.

‍ ‍

3.         Scan Results

‍ ‍

3.1.      Scans conducted by the Company are often completed at a gestation different to those conducted by the NHS. As a result, detection rates of abnormalities may be reduced. It is therefore important that you attend all your NHS antenatal services, and not view the Services provided by the Company as an alternative.

‍ ‍

3.2.      As a registered healthcare provider, First Glance Ultrasound has a duty of care to you, and will refer you on to the appropriate healthcare provider should any anomalies be suspected. First Glance Ultrasound has a relationship with the Norfolk and Norwich University Hospital (N&N) Early Pregnancy Assessment Unit (EPAU) and should a miscarriage or pregnancy of unknown location be suspected during your Scan, a referral can be made to the N&N, with your consent, and a Scan Report will be provided.

3.3.      Early Viability and Reassurance Scans

‍ ‍

(a)   You acknowledge that the ultrasound findings may be inconclusive for Early Viability and Reassurance Scans as it may be either too early to visualise on ultrasound or that the pregnancy is not viable. This is determined when the following is seen:

‍ ‍

                      i.        An intrauterine gestation sac with a mean sac diameter less than 25mm with no evidence of fetal pole.  Should this be the case, we will perform a repeat scan within 14 days from the last Scan. 

‍ ‍

                     ii.        ii. Fetal pole has a CRL[CT2]  of less than 7mm and no evidence of heart pulsation.  Should this be the case, we will perform a repeat scan within 7 days from the last Scan.

‍ ‍

 

‍ ‍

3.4.      Obtaining Images

‍ ‍

(a)   You acknowledge that there are factors which may limit obtaining clear images at the Scan, which include but are not limited to the following:

‍ ‍

                          i.          Fetal position;

‍ ‍

                         ii.          Body habitus; and

‍ ‍

                         iii.         Late gestation.

‍ ‍

(b)   The Client therefore further acknowledges that undertaking Scans at a different gestation to the optimal screening time may result in reduced image detail and information in the Scan Report.

‍ ‍

3.5.      Anomalies and Abnormalities

‍ ‍

(a)    Should a Qualified Sonographer identify any possible anomalies during the Scan, the findings with be openly discussed with you, and documented in the Scan Report.

‍ ‍

(b)    In the case of any anomalies or abnormalities being identified during the Scan, it will be recommended that you contact your midwife and/or seek medical advice from your General Practitioner.

‍ ‍

(c)    You accept full responsibility in ensuring that you consult with your midwife and/or NHS care provider, in accordance with the advice provided by First Glance Ultrasound. 

‍ ‍

3.6.      Miscarriage

‍ ‍

(a)    Following the Scan, should a Qualified Sonographer suspect, or the Scan indicates that, there has been a miscarriage, missed miscarriage, or suspected pregnancy of unknown location, the Scan Report will detail these findings to you. In these circumstances, with your consent, a referral will be made to the N&N EPAU. If a Client declines the referral, it will be recommended that you contact your midwife and/or seek medical advice from your General Practitioner.

(b)    The Company can provide contact information for the Early Pregnancy Unit at the local NHS hospital to the Client.

‍ ‍

4.         Rescan Policy

‍ ‍

4.1.      Fetal Sexing

‍ ‍

(a)              You acknowledge and accept that the accuracy of fetal sexing increases after 16 weeks gestation.

‍ ‍

(b)              There may be occasions where the Company is unable to provide fetal sexing on the day of your appointment. Should this occur, we will offer to you a further appointment for a duration of 15 minutes free of charge.

‍ ‍

(c)              If the Company is unable to identify gender at the new appointment, any further appointments booked by you will be charged at a discounted rate.

‍ ‍

4.2.      3D/4D Imaging

‍ ‍

(a)              There may be occasions where the Company is unable to provide clear 3D/4D images at a 3D/4D scan appointment. Should this occur, we will offer to you a further appointment for a duration of 15 minutes free of charge to try again.

‍ ‍

(b)              If the Company is unable to provide a clear 3D/4D image at the new appointment, any further appointments booked by you will be charged at a discounted rate.

‍ ‍

5.         Disclaimers

‍ ‍

5.1.      All Services performed by the Company shall not replace any primary healthcare provider service and it is therefore recommended that obtaining any Services from the Company should not be the only diagnostic services used throughout your pregnancy.

‍ ‍

5.2.      The Client acknowledges that fetal sexing is only 95% accurate and cannot be guaranteed. The Company accepts no liability for incorrect identification of gender.

‍ ‍

5.3.      Nothing in these Conditions shall be deemed as medical advice or otherwise.

‍ ‍

6.         Prices

‍ ‍

6.1.      Prices for our services are set out on our website. All prices are in pounds sterling (£)(GBP) and include VAT at the applicable rate.

‍ ‍

6.2.      Prices for our Services may change at any time without any prior notice.

‍ ‍

6.3.      We require an advance payment of 50% of the total Services cost when you book your appointment with us. We will take this payment from your card at the point of booking. If the payment is unsuccessful, we will try to contact you using the contact details you provided when you scheduled your appointment. If we are unable to contact you, we will cancel your appointment and notify you by email.

‍ ‍

6.4.      We require payment of the outstanding 50% of the total Services cost on the day of your appointment.

‍ ‍

6.5.      We accept cash and the following credit cards and debit cards: Any UK-issued and most international contactless, chip and PIN and magnetic stripe cards with a Visa, Mastercard, American Express, Maestro, Visa Electron, V Pay or Discover logo. All credit card and debit card payments need to be authorised by the relevant card issuer. We do not accept cheques.

6.6.      If your payment is not received by us when due, we may charge interest on any balance outstanding at the rate of 12% per annum above Bank Of England’s Bank plc’s base rate. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment.

7.         Appointments

‍ ‍

7.1.      You may book an appointment for the provision of any of the Services via the online booking system, hosted by Acuity Scheduling, here: Book Your Scan | Schedule Your Ultrasound Today — First Glance Ultrasound. Alternatively, appointments may also be booked over the telephone by calling 07791448368 or in person by dropping into the First Glance Ultrasound clinic.

7.2.      We will always try to accommodate your appointment should you be running late, however if you are more than 15 minutes late for your appointment, we may be unable to provide the Scan to you on the date of your appointment, and you will be charged the full price for this appointment.

‍ ‍

7.3.      Should you no longer be able to attend your appointment, you may reschedule this by providing no less than 48 hours’ notice. If you do your appointment, the 50% deposit will be carried over in respect of the new appointment and there will no further payment to be made until you have attended the new appointment.

‍ ‍

7.4.      In the event of any unexpected circumstance or delays outside of our control (for example loss of power, machine malfunction), appointments will be rescheduled by the Company at the next nearest availability. If the appointment is rescheduled to a time not suitable to you, a full refund of the deposit will be issued to you. The Company shall not be liable for any losses incurred by the Client as a result of the unexpected cancellation.

8.         Information Required

‍ ‍

8.1.      In order to provide the Services to you, we will ask you to complete a pre-scan questionnaire and a consent form, which will be sent out to you prior to your appointment.

‍ ‍

8.2.      If you do not provide this information, or provide incomplete or inaccurate information, we will be unable to carry out the Scan. In these circumstances, the Company reserves the right to cancel the contract or charge its reasonable costs in rectifying information. [CT3]

9.         Your Right to Cancel

‍ ‍

9.1.      You shall have the right to change your mind and cancel the Services within 14 days from the date of your appointment confirmation email and receive a refund.

‍ ‍

9.2.      In order to exercise this right, you must inform First Glance Ultrasound at the earliest opportunity, by clear statement, in writing. We ask that 48-hour notice is provided to cancel a scheduled appointment, where possible.

‍ ‍

9.3.      If your appointment is scheduled to take place during the 14-day cancellation period and we agree to do so, this will impact your cancellation rights as follows:

‍ ‍

(a)        you lose your right to cancel once the services are fully performed and will not be entitled to a refund even if the cancellation period has not expired;

‍ ‍

(b)        if the Services have not been fully performed, you will be required to pay for the Services we provided up to the time that you told us that you want to cancel.

‍ ‍

9.5.      We will provide you with a refund as soon as possible and no later than 14 days after the day on which you told us that you want to cancel. If Services have been provided during the cancellation period at your request, we will make deductions from any refund due to you as explained in clause 9.2 above.

9.6.      We will issue your refund to the same payment method you used when you placed your order.

10.      Data Protection And Data Processing

10.1.     Any personal information that you provide to us will be dealt with in line with Privacy Policy available here [insert link], which explains what information we collect and hold about you, and how we collect, store, use and share such information.

11.      Photography

‍ ‍

 

‍ ‍

11.1.   The Company does not permit any form of photography or recording at its clinic, before, during or after the provision of the Services.

‍ ‍

12.      Intellectual Property

‍ ‍

 

‍ ‍

12.1.   All Intellectual Property Rights in or arising out of or in connection with the Services shall be owned by the Company.

‍ ‍

 

‍ ‍

13.      Limitation of Liability

‍ ‍

 

‍ ‍

Your attention is particularly drawn to this clause.

‍ ‍

 

‍ ‍

13.1.   Nothing in these Conditions shall limit or exclude the Company’s liability for:

‍ ‍

 

‍ ‍

(a)        death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors; or

‍ ‍

(b)        fraud or fraudulent misrepresentation; or

‍ ‍

(c)        any other liability which cannot be limited or excluded by applicable law.

‍ ‍

 

‍ ‍

13.2.   Subject to clause 13.1, the Company shall not be liable to you, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Services for loss or damage to personal belongings whilst on the First Glance Ultrasound premises.

‍ ‍

 

‍ ‍

13.3.   Subject to clause 13.1, the Company's total liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Services shall be limited to the total price you have paid for the Services under these Conditions.

‍ ‍

14.      Force Majeure

‍ ‍

14.1.   For the purposes of these Conditions, Force Majeure Event means an event beyond the reasonable control of the Company including but not limited to strikes, lock-outs or other industrial disputes (whether involving the workforce of the Company or any other party), pandemic, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm, earthquake or natural disaster.

14.2.   The Company shall not be liable to you as a result of any delay or failure to perform its obligations under these Conditions as a result of a Force Majeure Event.

‍ ‍

14.3.   If the Force Majeure Event prevents us from providing any of the Services for more than 4 (four) weeks, we shall, without limiting its other rights or remedies, have the right to terminate the Services immediately by giving written notice to you.

‍ ‍

15.      Complaints

‍ ‍

These are subject to certain exceptions. For detailed information please visit the Citizens Advice website www.citizensadvice.org.uk.

15.2.   Summary of Key Legal Rights:

(a)   If your product is services, the Consumer Rights Act 2015 says:

‍ ‍

                      i.        You can ask us to repeat or fix a service if it's not carried out with reasonable care and skill, or get some money back if we can't fix it.

‍ ‍

                     ii.        If a price hasn't been agreed upfront, what you're asked to pay must be reasonable.

‍ ‍

                    iii.        If a time hasn't been agreed upfront, it must be carried out within a reasonable time.

‍ ‍

(b)   If your product is goods (i.e. the scan image), the goods must be as described, fit for purpose and of satisfactory quality.

‍ ‍

15.4.   Dispute Resolution

‍ ‍

Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you're not satisfied with the outcome you can still go to court.

‍ ‍

16.      Third Parties

‍ ‍

16.1.   This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

‍ ‍

17.      Severance

‍ ‍

17.1.   If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

‍ ‍

18.      Governing Law and Jurisdiction

‍ ‍

18.1.   This Agreement, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in connection with the Agreement.
